§ 2.10.040. Vacancy.

When a vacancy occurs on the council, if more than twenty-eight months remain in the term and the vacancy occurs not less than one hundred thirty days before the next consolidated election, the office shall be filled for the unexpired portion of the term by special election at that consolidated election. During the period from the time that the vacancy occurs until the next election of alders, the vacancy may be filled by the appointment of an alder by the mayor, with the advice and consent of the city council.
