§ 8.08.140. Receptacles.

  • A.

    The term "garbage receptacle" shall have the following meaning: A solid, durable metal or plastic container with a cover and handles, and without any leaks, breaks or cracks.

    B.

    Garbage receptacles shall be strong enough to avoid cracking or breaking under day to day use and stress involved in picking up and emptying the receptacles.

    C.

    Garbage receptacles used for household solid waste collection at single-family dwelling structures and multi-family dwelling structures consisting of two units or less shall have a capacity of not less than five gallons, nor more than ninety-six gallons.

    D.

    Garbage receptacles that have deteriorated or that have been damaged to the extent of being badly dented, leaking, without handles or covers, or having ill-fitting covers, or having jagged or sharp edges capable of causing injury to a collector licensed by the city shall be replaced or satisfactorily repaired prior to continued use.

    E.

    The owners of each single-family dwelling structure within the city shall provide an adequate number of garbage receptacles to sufficiently accommodate the amount of solid waste generated by the premises. The owners of each dwelling structure of two units within the city shall provide an adequate number of garbage receptacles to each unit to sufficiently accommodate the amount of solid waste generated by each unit.

    F.

    Every person occupying or in possession of a single-family dwelling structure or a dwelling unit in a multi-family dwelling structure of two units within the city shall maintain any and all garbage receptacles in good repair, and in a clean and sanitary condition.

    G.

    Every owner of a business, firm, restaurant, or multi-family dwelling structure of three or more units shall provide an adequate number of garbage receptacles to sufficiently accommodate the amount of solid waste generated by the premises and shall maintain the receptacles in good repair and in a clean and sanitary condition.

    H.

    Any building or buildings with two or more residence units must have an enclosed area for the placement and maintenance of garbage and trash receptacles with the enclosed area to be at least two feet higher than the top of the receptacle.

    I.

    No garbage shall be placed out of doors anywhere in the city unless it is securely contained in a garbage receptacle.

    J.

    All glass, all items with sharp corners, and all sharp objects shall be securely wrapped to prevent injury to any person collecting the waste material.
